4.1 Vehicle Information

We strive to provide accurate and up-to-date information about the vehicles available for sale. However, we do not warrant that the descriptions, pricing, or other content is accurate, complete, reliable, current, or error-free. We reserve the right to correct any errors or omissions and to change or update information at any time without prior notice.

4.2 Vehicle Inspection

Customers are encouraged to inspect the vehicle and, if desired, have a third-party inspection conducted before completing the purchase. By finalizing the purchase, the Customer acknowledges that they have had the opportunity to inspect the vehicle and are satisfied with its condition.

4.3 Test Drives

Customers may request a test drive of any vehicle available for sale. Test drives are subject to scheduling and availability. Customers must present a valid driver’s license and proof of insurance before a test drive.

5. Pricing and Payment

5.1 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. Prices do not include applicable taxes, title fees, registration fees, or any other fees required by law. These additional fees will be disclosed to the Customer at the time of purchase.

5.2 Payment Methods

We accept various payment methods, including cash, certified checks, and financing through third-party lenders. Payment in full is required at the time of purchase unless financing arrangements have been made.

5.3 Financing

Financing options are available through third-party lenders. Approval for financing is subject to the lender’s terms and conditions. Columbus Auto Group West does not guarantee financing approval. Customers are encouraged to review the financing terms carefully before agreeing to them.

6. Warranties and Service Contracts

6.1 Limited Warranty

All vehicles are sold “as-is,” with no express or implied warranties unless otherwise stated in a separate written agreement. Any warranties provided by third-party manufacturers or service providers are the sole responsibility of those entities.

6.2 Extended Service Contracts

Customers may have the option to purchase an extended service contract. These contracts are provided by third-party companies, and their terms and conditions will be outlined in a separate agreement. Columbus Auto Group West is not responsible for the fulfillment of these contracts.

7. Returns and Exchanges

All vehicle sales are final. Columbus Auto Group West does not offer returns or exchanges on vehicles once the purchase has been completed. Customers are encouraged to thoroughly inspect and test drive the vehicle before finalizing the purchase.

8. Limitation of Liability

To the maximum extent permitted by law, Columbus Auto Group West shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the purchase or use of a vehicle, even if we have been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, use, data, or other intangible losses.

9. Indemnification

Customers agree to indemnify, defend, and hold harmless Columbus Auto Group West, its affiliates, officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with their use of our services or the purchase of a vehicle.

Our Privacy Policy, which is incorporated into these Terms and Conditions or Terms and Agreement by reference, explains how we collect, use, and protect your personal information. When applying for car financing on our website application page or opting in to receive a text back from us on our home page, in addition to other information requested from you, our forms will also ask for your phone number and email. You will likely see a message just like the message right below. You are required to read before clicking to submit your information.

11. Dispute Resolution

11.1 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

11.2 Arbitration

Any disputes arising out of or relating to this Agreement, including the breach, termination, or validity thereof, shall be resolved by binding arbitration in Columbus, OH, in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

12. Miscellaneous

12.1 Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

12.2 Waiver

No waiver of any term or condition of this Agreement shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure to assert a right under this Agreement shall not constitute a waiver of such right.

12.3 Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral, with respect to such subject matter.

15.1 Online Vehicle Listings

We offer the option to view and purchase vehicles through our online platform. The same terms and conditions apply to online purchases as they do to in-person purchases. Customers are responsible for verifying all information about the vehicle before completing the purchase.

15.2 Online Payment

Payments made through our online platform are subject to the same conditions as outlined in Section 5.2. We use secure payment gateways to process online payments. Customers are responsible for ensuring the accuracy of their payment information.

15.3 Delivery and Shipping

If a vehicle is purchased online and delivery is requested, additional fees for shipping and handling may apply. Delivery times are estimated and not guaranteed. Columbus Auto Group West is not responsible for any delays caused by third-party shipping companies.

16. Trade-Ins

16.1 Trade-In Valuation

We offer trade-in options for Customers who wish to exchange their current vehicle for a new purchase. The value of the trade-in vehicle will be assessed based on its condition, age, mileage, and market value. Customers must provide accurate information about the trade-in vehicle.

16.2 Trade-In Process

The trade-in process will be completed at the time of purchase. The agreed-upon trade-in value will be applied towards the purchase price of the new vehicle. Customers are responsible for any remaining balance after the trade-in value has been applied.

17. Maintenance and Repairs

17.1 Service Center

We offer maintenance and repair services at our service center. Customers can schedule appointments for routine maintenance, repairs, and inspections. All services are performed by qualified technicians.

17.2 Service Fees

Service fees will be disclosed to the Customer before any work is performed. Additional fees may apply for parts and labor. Customers are responsible for paying all service fees at the time of service.

17.3 Warranty Repairs

If a vehicle is covered under a warranty, certain repairs may be performed at no cost to the Customer. Customers should review the terms of their warranty to determine what is covered.

18. Customer Responsibilities

18.1 Accurate Information

Customers are responsible for providing accurate and complete information when purchasing a vehicle or using our services. This includes providing valid identification, proof of insurance, and accurate payment information.

18.2 Vehicle Use

Customers agree to use the vehicle in accordance with all applicable laws and regulations. This includes maintaining the vehicle in good condition and ensuring it is regularly serviced.

18.3 Insurance

Customers are required to maintain valid insurance coverage for their vehicle at all times. Proof of insurance must be provided at the time of purchase and upon request.

19. Dealership Rights

19.1 Refusal of Service

We reserve the right to refuse service to any Customer for any reason, including but not limited to providing false information, failure to comply with these Terms and Conditions, or engaging in fraudulent or illegal activities.

19.2 Vehicle Availability

All vehicles are subject to availability. We do not guarantee that any specific vehicle will be available for purchase. We reserve the right to remove any vehicle from our inventory at any time.

20. Promotional Offers

20.1 Special Promotions

From time to time, we may offer special promotions, discounts, or incentives. These promotions are subject to specific terms and conditions, which will be disclosed at the time of the promotion. Promotional offers cannot be combined with other offers unless explicitly stated.

We reserve the right to terminate or suspend a Customer’s access to our services at any time, for any reason, including but not limited to violation of these Terms and Conditions, fraudulent or illegal activities, or failure to pay for services rendered.

27. Force Majeure

We are not liable for any failure to perform our obligations under these Terms and Conditions if such failure is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or interruptions in internet or communication services.

28. Assignment

Customers may not assign or transfer their rights or obligations under this Agreement without the prior written consent of Columbus Auto Group West. We may assign or transfer our rights and obligations under this Agreement at any time without notice to Customers.

29. Notices

Any notices required or permitted under this Agreement shall be in writing and shall be deemed given when delivered personally, sent by email to the address provided by the Customer, or sent by certified or registered mail to the Customer’s address on file.

30. Headings

The headings in this Agreement are for convenience only and shall not affect the interpretation of these Terms and Conditions.

31. Survival

The provisions of this Agreement that by their nature should survive termination shall survive any termination or expiration of this Agreement, including but not limited to Sections 8 (Limitation of Liability), 9 (Indemnification), and 11 (Dispute Resolution).

32. Letigation and Dispute Location

All letigation and arbitrations will be done in Columbus OH. You agree to arbitration also.
